Terms of Service
These Terms of Service govern your access to and use of all products and services provided by HIREMEDIAMIND LLP ("Company", "we", "our", "us"), including GrowthOS, Reputation OS, Outreach OS, and all associated features and APIs.

1. Agreement to Terms
By accessing or using any HIREMEDIAMIND LLP product, website, or service, you ("Client", "you", "your") confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.
These Terms apply to all users of our SaaS products. Where you use our services on behalf of a company or organisation, you represent that you are authorised to bind that entity to these Terms.
2. Our Services
HIREMEDIAMIND LLP is an AI automation software company. We build and operate SaaS products that help businesses automate growth, outreach, reputation management, and customer engagement using artificial intelligence.
Our current products include:
- GrowthOS: An AI-powered business growth platform featuring 6 AI agents (Alex, Sam, Maya, Leo, Zara, Ravi) that automate lead discovery, WhatsApp outreach, review management, bookings, content creation, and analytics for Indian SMBs and enterprises
- Reputation OS: A review management and Google Business Profile monitoring platform
- Outreach OS: An email outreach automation and sequence management platform
- Custom AI Systems: Bespoke AI automation solutions built for individual enterprise clients

3. Accounts and Subscriptions
To access our SaaS products, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Subscriptions are billed in advance on a monthly or annual basis as selected at sign-up
- Trial periods, where offered, are subject to the terms stated at the time of sign-up
- You may cancel your subscription at any time through your account settings or by contacting us
- Cancellation takes effect at the end of the current billing period; no pro-rata refunds are issued for unused time unless required by applicable law
- We reserve the right to modify pricing with 30 days' advance notice to existing subscribers
4. Payment Terms
All fees are payable in INR (Indian Rupees) unless otherwise stated. Payments are processed securely through Razorpay. We do not store card details.
- Subscription fees are due at the start of each billing period
- AI credit top-ups and add-ons are charged at the time of purchase
- Failed payments may result in service suspension after a 7-day grace period with notification
- All prices are exclusive of applicable taxes (GST); taxes will be added at checkout where required
- Disputed charges must be raised within 30 days of the billing date
5. Client Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information about your business
- Maintain all necessary permissions and account access required for our services to function
- Comply with all applicable laws, including Indian telecom regulations (TRAI), data protection laws (DPDP Act 2023), and the laws of your clients' jurisdictions
- Use our services only for lawful business purposes
- Not use our services to harm, deceive, defraud, or harass any individual or business
- Pay fees as agreed and on time
- Review and approve all AI-generated actions before they are executed (where approval is required)
6. Acceptable Use Policy
You must not use our services, or permit others to use them, to:
- Send unsolicited bulk communications (spam) of any kind
- Violate any applicable law, regulation, or third-party rights
- Distribute malware, viruses, or any harmful code
- Scrape, copy, or reverse-engineer our platform or data
- Circumvent or attempt to circumvent any security, rate limiting, or access control measures
- Impersonate any person, business, or entity
- Use AI features to generate content that is false, defamatory, discriminatory, or misleading
- Engage in any activity that could damage our reputation or that of our platform partners (including Meta)
- Share account credentials with unauthorised third parties
- Use our services for any purpose related to the development of competing products
We reserve the right to immediately suspend or terminate accounts found in violation of this Acceptable Use Policy without prior notice.
7. WhatsApp Business Messaging Policy
GrowthOS includes WhatsApp Business campaign and outreach features. HIREMEDIAMIND LLP operates as a WhatsApp Business Solution Provider (BSP) in connection with Meta Platforms, Inc. and authorised Meta technology partners, including AiSensy. By using these features, you agree to the following additional terms.
7.0 Security and Campaign Controls
For security and compliance reasons, WhatsApp campaign features in GrowthOS may require Business User verification, template approval, send-rate limits, opt-out enforcement, and manual or automated review before messages are dispatched. We may pause, queue, or block campaigns that present policy, deliverability, fraud, or data-security risk. You agree not to attempt to bypass these controls.
7.1 Compliance with Meta's Policies
You must comply with Meta's WhatsApp Business Policy, Meta's Terms of Service, and all applicable Meta Commerce and Messaging policies. These policies form part of your agreement with us for WhatsApp features.
7.2 Prohibited WhatsApp Messaging Activities
You must NOT use GrowthOS WhatsApp features to:
- Send messages to recipients who have not provided consent to receive WhatsApp communications from your business
- Send unsolicited bulk messages, spam, or mass non-personalised broadcasts
- Promote adult content, gambling services, weapons, illegal drugs, or any other content prohibited by Meta's policies
- Impersonate another business or individual in your WhatsApp communications
- Circumvent WhatsApp's opt-out or blocking mechanisms
- Use purchased, rented, scraped, or otherwise improperly obtained phone number lists
- Send content that is deceptive, misleading, fraudulent, or in violation of any applicable consumer protection law
- Conduct unsolicited political campaigning or religious mass messaging
- Send messages at volumes or frequencies that could constitute harassment
7.3 Your Responsibilities for WhatsApp
You are solely responsible for:
- Ensuring all WhatsApp message recipients have provided valid consent to receive communications from your business
- Maintaining your WhatsApp Business Account (WABA) in good standing with Meta
- Maintaining a Green quality rating on your WhatsApp Business number
- Complying with TRAI's Telecom Commercial Communications Customer Preference Regulations where applicable
- Providing accurate business information during WABA registration and verification
- The content and accuracy of all messages sent through GrowthOS on your behalf
7.4 Opt-Out Compliance
You must honour all STOP/unsubscribe requests from WhatsApp message recipients within 24 hours. GrowthOS automatically detects STOP replies and flags them in your system to prevent further messages to that recipient. You must not override or circumvent this system.
7.5 WhatsApp Account Suspension
HIREMEDIAMIND LLP may immediately suspend your WhatsApp campaign access, without prior notice, if:
- Meta flags your WhatsApp Business Account for policy violations
- Your WhatsApp Business number quality rating drops to Red
- We reasonably believe you are violating this policy or Meta's WhatsApp Business Policy
- We receive a notice from Meta or a regulatory authority requiring us to do so
WhatsApp access suspension does not entitle you to a refund of subscription fees.
7.6 No Guarantee of Deliverability
WhatsApp message delivery depends on Meta's infrastructure, recipient device settings, and Meta's content moderation. HIREMEDIAMIND LLP does not guarantee delivery rates, open rates, reply rates, or any other outcome for WhatsApp campaigns.
8. AI Features and Human Oversight
GrowthOS uses Claude AI (provided by Anthropic, PBC) to power its AI agents. By using AI features, you acknowledge:
- AI-generated content (messages, reports, briefs) may occasionally contain errors and must be reviewed by you before use
- You retain full responsibility for all actions taken using AI-generated suggestions
- We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output
- AI features may be temporarily unavailable due to third-party service outages (Anthropic or others); this does not constitute a service failure entitling you to a refund
- Your use of AI features is subject to Anthropic's Acceptable Use Policy
9. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that by using our services, your data and the data of your customers may be processed as described in the Privacy Policy.
Where you upload or provide data about third parties (such as customer contact lists) to our platform, you represent and warrant that you have the legal right and all necessary consents to share that data with us for the purposes described in these Terms and our Privacy Policy.
10. Intellectual Property
HIREMEDIAMIND LLP retains all ownership of our platform, software, AI models, methodologies, algorithms, tools, documentation, and all associated intellectual property. Nothing in these Terms transfers any IP rights to you.
You retain full ownership of your brand assets, business data, customer data, and any content you create or upload. You grant us a limited, non-exclusive licence to process your data and content solely to provide our services to you.
11. Confidentiality
Each party agrees to keep the other's confidential information (including business data, pricing, and technical details) confidential and not to disclose it to third parties without prior written consent. This obligation survives termination of these Terms for a period of 3 years.
12. Service Availability
We aim for 99.9% uptime for our core platform. Scheduled maintenance will be communicated at least 24 hours in advance where possible. We are not liable for downtime caused by third-party infrastructure (hosting, AI providers, WhatsApp/Meta), force majeure events, or circumstances beyond our reasonable control.
13. Disclaimers
Our services are provided "as is" and "as available." We do not warrant that our services will be error-free, uninterrupted, or fit for any particular purpose. We do not guarantee specific business outcomes, revenue growth, lead conversion rates, review counts, or any other commercial results from using our products.
AI automation tools assist with, but do not replace, your business judgement. All final decisions on messaging, content, pricing, and business strategy remain your responsibility.
14. Limitation of Liability
To the fullest extent permitted by applicable law, HIREMEDIAMIND LLP's total liability to you for any claims arising from or relating to these Terms or our services shall not exceed the total fees paid by you in the 3 months immediately preceding the claim.
In no event shall HIREMEDIAMIND LLP be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, loss of data, loss of customers, loss of goodwill, or business interruption, even if advised of the possibility of such damages.
15. Indemnification
You agree to indemnify, defend, and hold harmless HIREMEDIAMIND LLP and its officers, partners, and employees from any claims, damages, losses, costs (including legal fees), or liabilities arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights, including Meta's WhatsApp Business Policy; or (d) the content or legality of messages you send through our platform.
16. Account Termination
Either party may terminate these Terms at any time. You may cancel your account through your account settings. We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in conduct that puts our platform or other users at risk. Upon termination:
- Your access to our services will cease at the end of the current billing period (cancellation) or immediately (termination for cause)
- You may request an export of your data within 30 days of termination via our data export feature
- After 30 days from account closure, we will delete your data in accordance with our Privacy Policy retention schedule
17. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by email and by posting an updated version on this page with a revised date. Continued use of our services after the effective date of changes constitutes your acceptance of the updated Terms.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jhansi, Uttar Pradesh, India. If you are located outside India, you consent to jurisdiction in Jhansi, Uttar Pradesh for the resolution of any dispute.
19. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire Agreement
These Terms, together with our Privacy Policy and any applicable order forms or service agreements, constitute the entire agreement between you and HIREMEDIAMIND LLP regarding your use of our services and supersede all prior agreements and understandings.
